MotoCast — Terms and Conditions

1. About these terms

These Terms and Conditions ("Terms") are a legal agreement between you and FILL IN — your full legal / trading name ("MotoCast", "we", "us", "our") and govern your use of the MotoCast app on Android and the web app at https://motocast-v2.vercel.app (together, the "App" or the "Service").

By downloading, installing or using the App, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the App.

We may update these Terms (see Section 19). The version in force is the one published in or linked from the App at the time you use it.

2. Who can use MotoCast

You may use the App only if you are 18 or over and able to enter into a binding contract. The App is intended for adults who ride or plan motorcycle journeys. By using it you confirm you meet this requirement.

3. What MotoCast is (and its beta status)

MotoCast is a weather-intelligent motorcycle route planner and turn-by-turn navigation aid for the UK. It scores routes against the weather forecast along them, suggests food and fuel stops, shows the locations of speed cameras, and provides voice-guided navigation.

The App is currently provided as beta software. That means it is still in development, may contain bugs or inaccuracies, may change, and may be unavailable or discontinued. We provide it to help you, but you use it understanding that it is not a finished product.

4. Your account

• Much of the App works without an account. Some features need you to sign in, using an email magic-link or "Continue with Google".
• You're responsible for keeping access to your account and device secure, and for activity that happens under your account.
• Tell us promptly at admin@motocast.app if you think your account has been accessed without your permission.
• You can delete your account at any time in Settings → Delete account.

5. Acceptable use

You agree not to:

• use the App in any unlawful way, or while doing so would be unsafe or illegal (see Section 7);
• interfere with, attack, reverse-engineer (except as the law allows), or try to gain unauthorised access to the App, our servers or other users' data;
• use any feature to generate or seek unlawful, harmful or abusive content, or to place automated or excessive load on the Service;
• scrape, resell or commercially exploit the App or its data without our permission; or
• misuse third-party data shown in the App (for example fuel, camera or review data) in breach of the relevant provider's terms.

We may suspend or end your access if you break these Terms (see Section 17).

6. Riding territory and local law

The App is designed and intended for use in the United Kingdom. Requests outside the UK are refused.

If you take a device running the App outside the UK, you are responsible for complying with local law. In particular, some countries restrict or prohibit apps and devices that warn of, or display the location of, speed-enforcement cameras (for example certain rules in France, Germany and Switzerland). Do not use, and do not rely on, the speed-camera features where doing so is restricted or unlawful. You use the App outside the UK at your own risk.

7. Safety, and not relying on the App (important)

MotoCast is an aid to planning and riding. It is not a substitute for safe riding, your own judgement, or compliance with the law. By using the App you understand and agree that:

• Riding safely is always your responsibility. You must obey the Highway Code, road signs, road markings, traffic signals, speed limits and all applicable laws at all times, regardless of anything the App shows or says.
• Do not interact with the App while riding. Set up your route before you set off, mount your device securely and legally, and pull over safely if you need to change anything. Holding or operating a hand-held device while riding is illegal. Voice guidance is there so you can keep your eyes on the road.
• Navigation may be wrong or out of date. Roads, closures, restrictions, one-way systems and conditions change. Always follow the actual road layout, signs and conditions in front of you, not the App, if they ever conflict.
• Weather information is an estimate. Forecasts and ride "scores" are predictions that can be inaccurate and can change quickly. They do not guarantee the conditions you will meet. Use your own assessment of the weather and your ability.
• Speed-camera information is for information only. It may be incomplete, inaccurate or out of date, and it is never a reason to speed. You must always ride within the speed limit and the law. We do not provide camera information to help anyone break the law.
• Fuel and place information comes from third parties. Prices, opening hours, availability and ratings (including TripAdvisor data) may be inaccurate or out of date. Check before relying on them.
• Planned routes are suggestions only. A route, a weather score or a suggested stop may be imperfect, impractical or unsuitable. Review any suggestion yourself before acting on it.

If conditions are unsafe, do not ride. Nothing in the App should be treated as advice that it is safe to ride a particular route at a particular time.

8. Third-party services and content

The App relies on third-party services and data, including routing and navigation (TomTom), mapping and place search (Stadia Maps), weather (Open-Meteo), place reviews (TripAdvisor), public camera data (OpenStreetMap) and public fuel data (UK Government Fuel Finder). We don't control these services and aren't responsible for their content, accuracy or availability, and your use of features that depend on them may also be subject to those providers' own terms. We may add, change or remove third-party services.

9. Your content and our intellectual property

• Your content. Routes, saved places, "dream" rides and other content you create remain yours. By using the sharing feature you grant us a limited, non-exclusive licence to host and display that content on the public share page only while you choose to share it, so that people with the link can view it. You can stop sharing at any time. You're responsible for what you choose to make public.
• Our content. The App itself — its software, design, branding, text and other materials (other than third-party data and your content) — belongs to us or our licensors and is protected by intellectual property law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for your own non-commercial use in line with these Terms. You may not copy, modify, distribute, sell or create derivative works from it except as the law allows.

10. Availability, changes and beta

We aim to keep the App available and working, but we don't promise it will be uninterrupted, error-free or always available. As beta software, features may change, break or be withdrawn, and we may suspend the Service for maintenance or other reasons. Because the Android app bundles the web build, some changes only reach your phone after an app update.

11. Price

The App is currently provided free of charge during beta. If we introduce paid features in future, we will set out the price and any additional terms (including your statutory cancellation rights for paid digital content) before you buy, and those terms will apply to that purchase.

12. Your statutory consumer rights

Nothing in these Terms affects your rights as a consumer that cannot be excluded or limited by law. In the UK, the Consumer Rights Act 2015 gives you statutory rights in relation to digital content and services — for example that a service is provided with reasonable care and skill, and that digital content is as described and of satisfactory quality. If you are in the EU, you have equivalent statutory rights under local consumer law. These statutory rights sit alongside these Terms and take priority over anything inconsistent with them.

13. Disclaimers

To the extent permitted by law, and without affecting Sections 7 and 12, the App is provided "as is" and "as available". We do not give any warranties or guarantees that the App, or the data and suggestions it provides (including routes, weather scores, camera locations and fuel information), will be accurate, complete, current, reliable, uninterrupted or fit for a particular purpose, beyond the statutory rights described in Section 12.

14. Our liability to you (important)

Nothing in these Terms limits or excludes our liability for:

• death or personal injury caused by our negligence;
• fraud or fraudulent misrepresentation; or
• any other liability that cannot legally be limited or excluded, including your non-excludable rights under the Consumer Rights Act 2015.

Subject to that:

• We are not liable for loss or damage that was not foreseeable, that arises from your own failure to ride safely or lawfully or to follow the actual road and weather conditions, or that arises from your reliance on information the App expressly tells you to verify or not to rely on (Section 7).
• We are not liable for losses arising from circumstances outside our reasonable control, from third-party services we don't control, or from the App being unavailable or containing bugs given its beta nature.
• We provide the App for personal, non-commercial use. We are not liable for any business losses (such as loss of profit, business, or business opportunity).
• Where we are liable to you and the law allows a cap, our total liability arising out of or in connection with the App and these Terms is limited to FILL IN — liability cap — e.g. "£100, or the amount you have paid us for the App in the 12 months before the claim, whichever is greater".

This Section does not take away the statutory rights described in Section 12.

15. Indemnity

You agree to be responsible for, and to reimburse us for, any loss we suffer because you have used the App unlawfully, in breach of these Terms, or in a way that infringes someone else's rights. This does not apply to the extent the loss results from our own breach or negligence, and it does not reduce your statutory consumer rights.

16. Privacy

How we handle your personal data is explained in our Privacy Policy, which forms part of your use of the App.

17. Suspension and termination

• You can stop using the App at any time and delete your account in Settings → Delete account.
• We may suspend or end your access (with notice where reasonable) if you materially breach these Terms, use the App unlawfully or unsafely, or where we need to for legal, security or operational reasons, or if we discontinue the App.
• Ending your access doesn't affect any rights or obligations that arose beforehand. Sections that by their nature should survive (for example Sections 7, 9, 13, 14, 15 and 20) continue to apply.

18. If something goes wrong — complaints

If you have a problem or complaint, please contact us at admin@motocast.app and we'll do our best to resolve it. For complaints specifically about how we handle your personal data, see the "Complaints" section of our Privacy Policy.

19. Changes to these Terms

We may change these Terms from time to time, for example to reflect new features, third-party changes, or changes in the law. We'll update the "Last updated" date and, for significant changes, bring them to your attention in the App. If you continue using the App after a change takes effect, you accept the updated Terms. If you don't agree, please stop using the App and delete your account.

20. Governing law and where you can bring a claim

These Terms and any dispute arising out of them are governed by the law of England and Wales. You and we agree that the courts of England and Wales have jurisdiction — except that, if you are a consumer resident elsewhere in the UK or in the EU, you may also bring proceedings in your own country, and you keep the protection of any mandatory consumer-protection laws of the country you live in.

21. General

• Whole agreement. These Terms and the Privacy Policy are the whole agreement between us about the App.
• Severability. If any part of these Terms is found unenforceable, the rest continues to apply.
• No waiver. If we don't enforce a right straight away, we can still enforce it later.
• Assignment. You may not transfer your rights under these Terms. We may transfer ours if your rights are not adversely affected.
• No third-party rights. No one other than you and us has any rights to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999.
